View from Wiley Rein: I Can Protest, But Should I?

Every year around this time, just as baseball’s regular season is winding down, another season is picking up—bid protest season. The government spends a substantial amount of its appropriated money in the fourth quarter of its fiscal year, which ends on September 30.  For example, it is estimated that in 2014, the government will spend 35 percent of its annual contract funds in the fourth quarter, with a possible $85 billion in September alone. With this increase in contract actions come a greater number of disappointed offerors and increased opportunities to protest award decisions.
