Wiley Rein’s Kirk Nahra Featured in Bloomberg BNA Interview on Health Data Security
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was featured by Bloomberg BNA yesterday in an interview on the state of health information security and federal data security enforcement efforts.
The Federal Trade Commission’s (FTC) role in privacy enforcement, and recent changes to privacy rules under the Health Insurance Portability and Accountability Act (HIPAA) were among the topics Mr. Nahra discussed with Donald G. Aplin, senior legal editor of Bloomberg BNA’s Privacy and Security Law Report.
“The FTC is asserting its authority to bring data security cases against any company that it thinks is violating the FTC’s consumer protection principles,” Mr. Nahra said in the interview. “That’s a big deal for HIPAA-covered entities and business associates—who now need to worry about the FTC as well as the Department of Health and Human Services Office for Civil Rights and state attorneys general.”
