Kirk Nahra Featured in Bloomberg BNA Webinar on Top Health Privacy and Security Issues of 2015
Kirk J. Nahra, chair of Wiley Rein's Privacy Practice and co-chair of the Health Care Practice, was featured in a recent Bloomberg BNA webinar on the top ten health care privacy and security issues to watch in 2015. Those issues include the increasing pressure faced by health care companies to improve their data security practices.
There are too many security breaches in the health care industry-and the problem is likely to continue, according to Mr. Nahra, whose presentation was the subject of a March 9 article in BNA's Privacy & Data Security Law Resource Center. For example, health insurer Anthem Inc. disclosed last month that it had experienced a cyberattack that affected 80 million people.
"The Anthem one stands out because of its size and stands out because of just the volume of records that were affected," Mr. Nahra said. "Paying attention to the problems faced by others is a good way to sort of think about where the real problem areas are."
Mr. Nahra, a member of the advisory board for BNA's Privacy & Security Law Report, said he frequently receives enforcement-related queries about Health Insurance Portability and Accountability Act (HIPAA) audits.
While it is possible that a randomly selected HIPAA audit can lead to enforcement at a company, "I don't think people who have paid reasonable attention to HIPAA should be too concerned about the audit process," he said. "I do think it is worth it for most companies planning a little bit for the audit, even though only a small percentage of companies are going to get an audit."
