Wiley Rein Insurance Practice partner Laura Foggan was quoted in an August 24 article focused on possibly complicated insurance claims after an earthquake rattled the east coast. While structural damage was minimal to nonexistent after the 5.8 magnitude earthquake that struck on August 23, insurance claims could still get complex. One possible scenario could be if a tenant is unable to occupy a space due to damage and the landlord is expected to pay for lost time or relocation. Most owners would not be prepared for such a case given that few earthquake policies are purchased in the region hit by the earthquake. "It seems unlikely that there will be many viable insurance coverage claims from yesterday's events, since business income coverages are unlikely to apply and even coverage for direct physical damage is unlikely given the prevalence of earthquake and land movement exclusions," Ms. Foggan said.
