Kirk Nahra Discusses Potential for National Data Breach Law in 2012
Privacy Practice chair Kirk Nahra was interviewed by Consumer Protection Law360 as part of a feature on legislation to watch for in 2012. Mr. Nahra focused on a national data breach law, which could include a federal standard for data breach notification.
The article reported that currently most states have their own data breach laws while many businesses want a uniform federal standard. Mr. Nahra said that if a privacy bill were to pass, it is “highly likely” that it would include both general security standards and a federal breach notification provision.
“I think it's more likely than not that [a privacy law] will pass—but not a lot more likely than not,” said Mr. Nahra, while adding that passing legislation in a general election year is always more difficult.
