Michael Toner Discusses the Implications of the John Edwards Trial

Wiley Rein Election Law & Government Ethics Practice co-chair Michael Toner was a guest on MSNBC’s “The Daily Rundown” hosted by Chuck Todd to comment on the criminal trial of former presidential candidate John Edwards, who is accused of breaking campaign finance laws in order to hide an extramarital affair.

Mr. Toner said the prosecution’s case lacked specifics and questioned whether it should have been brought.

“This is an unprecedented case. This is a criminal case where you have to show beyond a reasonable doubt that John Edwards and his campaign knowingly and willfully violated election laws,” said Mr. Toner, former chairman of the Federal Election Commission (FEC).  “And actually there are FEC precedents and advisory opinions and enforcement cases that could be read to be contrary to the prosecution’s case here.”
