Kirk Nahra Comments on OCR Targeting Smaller Breaches
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in an August 19 Politico: Morning eHealth article regarding the U.S. Department of Health and Human Services’ Office for Civil Rights (OCR) announcement that the office will begin investigating breaches with less than 500 patient records more aggressively.
Mr. Nahra said that this was a “heads up” and that “just because a breach is small doesn’t [mean] it doesn’t still matter. He pointed out this is particularly true for “entities that have had earlier or repeated problems.”
