Kirk Nahra Comments on Recent HIPAA Violation Involving Business Associate Agreement
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in a September 26 Bloomberg BNA Health Care Blog article regarding the potential consequences for health care organizations that lack up-to-date business associate agreements (BAA) with their vendors. In a recent case, the U.S. Department of Health and Human Services’ Office for Civil Rights announced a $400,000 settlement with a Providence, Rhode Island-based health provider whose BAA had not been updated to reflect current HIPAA privacy requirements.
Mr. Nahra told BNA he did not think the settlement was targeting business associates, but rather was part of a larger government strategy to research the failure of HIPAA-covered entities to maintain up-to-date BAAs.
