Kirk Nahra Discusses Health Privacy and Security on The Week in Health Law Podcast
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was interviewed for The Week in Health Law podcast that was posted October 2. During the 42-minute conversation, Mr. Nahra discusses the Federal Trade Commission (FTC) v. Wyndham ruling, health data inside and outside the HIPAA zone, and the future of health privacy.
“I like the more flexible standards of the FTC,” Mr. Nahra said. “The hardest single question I get asked by clients these days is, ‘Am I in compliance with the HIPAA security rule or the FTC’s standards?’ To some extent, the answer is you don’t know until it’s tested. And that is a frustrating place to be. [The FTC is] not nitpicking around the edges. They are going after companies that have had major problems and haven’t done even a reasonable job of going after that.”
