Kirk Nahra Discusses Medical Center Settlement to Resolve Alleged HIPAA Violations
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in a Bloomberg BNA Health Care Blog article about a $2.7 million settlement by a university medical center to resolve alleged Health Insurance Portability and Accountability Act (HIPAA) violations, after a password-protected laptop containing 10,000 patient records was stolen in 2013.
Mr. Nahra told BNA the settlement is proof that the government will go after covered entities that have unresolved or egregious HIPAA compliance failures. He also said the U.S. Department of Health and Human Services’ Office of Civil Rights is less likely to take action if it finds that a covered entity tried to comply with HIPAA, but still had some problems.
