Kirk Nahra Discusses Potential Risks for New Health Care Technology
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in a January 6 Orlando Sentinel story, discussing the potential risks for health care tech company, Smrxt. According to the article, Smrxt is designing pill bottles that will be able to record and send information to health care providers.
“Smrxt would be subject to HIPAA health care privacy regulations if they supply doctors or hospitals, but not necessarily if they sell directly to patients,” Mr. Nahra said.
“On its face, it sounds good. But what happens next? What happens to the data? Will they raise your rates and deny claims?” he said. “There will be a lot of questions about accuracy, etc.”
