Kirk Nahra Weighs In On HIPAA Privacy Rule Settlement
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in an article published in Bloomberg BNA’s Health Care Daily Report article about a recent settlement between a North Carolina orthopedic clinic and the government to resolve allegations of violations to the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule.
According to the article, the settlement with the U.S. Department of Health and Human Services’ Office for Civil Rights resolved allegations that Raleigh Orthopaedic Clinic disclosed protected health information to a business partner without having previously signed a business associate agreement.
“The other significant reminder, which may be more of an actual issue, is for business associates to remember that they need downstream business associate agreements with their downstream subcontractors,” Mr. Nahra said.
