Mark Sweet Discusses Possible Effects Scalia’s Death Has Upon FCA Cases

Mark B. Sweet, a partner in Wiley Rein’s White Collar Defense & Government Investigations Practice, was quoted in an article published yesterday in Bloomberg BNA’s Federal Contracts Report about what the death of Justice Antonin Scalia could mean for False Claims Act (FCA) cases pending before the Supreme Court of the United States.

Mr. Sweet told the publication that Justice Scalia’s death probably will not have much effect on FCA-related cases because the justices are not as divided on that issue as they are on some others.

“Justice Scalia’s passing is unlikely to have a major impact on the False Claims Act cases,” Mr. Sweet said. “The justices don't have the same ideological fault lines on the False Claims Act as they do on social and political issues. The last few Supreme Court decisions involving the False Claims Act haven’t been close.”
