Wiley Rein & Fielding Wins Major Election Law and First Amendment Case

Washington, DC—Jan Baran, Thomas Kirby and Carol Laham of Wiley, Rein & Fielding were victorious in a significant election law and First Amendment case, FEC v Colorado Republican Federal Campaign Committee, ruled by the U.S. Court of Appeals for the 10th Circuit on May 5. The court affirmed the district court and declared unconstitutional a federal election law that limits the amount of hard money that a political party may spend in coordination with and on behalf of the party's candidates for the House and Senate. This case commenced in 1986 and has already been to the Supreme Court and is expected to go to the high court again.

Mr. Baran has been lead counsel on the litigation from the commencement of the case. Mr. Kirby successfully argued the summary judgement and Mr. Baran argued the appeal and before the Supreme Court. Kirk Jowers formerly of Wiley, Rein & Fielding also assisted in the district court and court of appeals in the most recent round.
