Counsel for Nucor Corporation Applauds ITC Decisions on Hot-Rolled Sunset Reviews

Washington, DCAlan H. Price, counsel to Nucor corporation, issued the following statement applauding today’s determinations of the U.S. International Trade Commission (“ITC”) in the sunset review of the antidumping and countervailing duty orders covering imports of hot-rolled sheet. 

“The ITC correctly recognized that imports of hot-rolled sheet from China, India, Indonesia, Taiwan, Thailand and Ukraine would injure the domestic industry if the orders were removed,” said Mr. Price, a partner with Wiley Rein in Washington, DC.  “China has a staggering amount of excess capacity, while the other countries depend on exports to maintain production,” he added.  “Maintaining these orders is critical to the domestic steel industry, and we are pleased that the ITC has recognized the importance of these orders.”

The ITC made its decision in the sunset review after a full investigation of whether revocation of the orders would likely lead to the continuation or recurrence of material injury to the domestic industry.  The ITC made negative determinations with regard to Argentina, Kazakhstan, Romania and South Africa.  “Although we are disappointed with these determinations, on balance we are pleased with the result,” said Mr. Price.
