Laura Foggan to Discuss Cyber Coverage Issues at ABA Event
Laura A. Foggan, chair of Wiley Rein’s Insurance Appellate Group, is among the distinguished panelists scheduled to speak at this week’s American Bar Association (ABA) 2015 Insurance Coverage Litigation Committee CLE Seminar in Tucson, Arizona.
The March 6 plenary session featuring Ms. Foggan is titled “Cyber Attacks and Privacy Perils: Understand and Mitigate Your Risk Through Insurance.” The panel will focus on coverage issues that have arisen in the wake of massive cyberattacks against companies such as Target, Sony Pictures, and Anthem Inc.
Ms. Foggan will discuss the rulings in early cases addressing data breach, privacy, and other cyber claims under commercial general liability (CGL) coverage. To the extent that coverage is found in such cases, it has been limited. CGL coverage plainly does not encompass all data breach, privacy and cyber losses—even when courts find some coverage.
Ms. Foggan will also explain limitations on policyholder efforts to find coverage for cyber claims under crime insurance, directors and officers, errors and omissions, and property insurance policies.
