Eve represents broadcast and other communications clients in a wide variety of regulatory matters before the Federal Communications Commission (FCC) and in litigation before federal and state courts.

Representative Experience

  • Counsels clients on media ownership regulation by the FCC. Represents major broadcast companies in federal appellate challenges to FCC media ownership rulings and in all aspects of related FCC proceedings on media ownership issues.
  • Represents broadband Internet access providers in administrative and appellate proceedings concerning "net neutrality" regulation. Counsel for Verizon in its successful challenge to the FCC's Open Internet rules before the U.S. Court of Appeals for the D.C. Circuit. Previously represented Comcast Corporation in its successful appellate challenge to the FCC's first "net neutrality" decision.  Also previously represented Verizon in appellate litigation concerning broadband regulation, including before the Ninth Circuit and Supreme Court in Brand X Internet Services v. FCC.
  • Counsels clients on the FCC implications of bankruptcies, reorganizations and restructurings. Represented a major financial institution in FCC proceedings and FCC-related aspects of litigation stemming from the bankruptcy of Tribune Company.
  • Represents major national broadcast and other communications companies in FCC rulemaking proceedings-and often in related litigation-involving a broad range of issues affecting the mass media, including the broadcast incentive auction, cable carriage issues, broadcast localism, and children's television.
  • Represents major national broadcast and other communications companies in enforcement proceedings involving indecency, sponsorship identification, and a variety of other matters before the FCC.
  • Advises broadcast companies on FCC compliance and reporting requirements with particular emphasis on media ownership, indecency, sweepstakes and contests, and advertising issues.
  • Advises clients on regulation of telecommunications carriers and their access to rights-of-way by state and local governments. Represents a major national telecommunications company in rights-of-way litigation before federal and state appellate and trial courts.
  • Represented a coalition of wireless carriers in successful litigation involving the first test of state legislative authority over wireless rates and business practices.
  • Represents major national corporations and trade associations in federal district court and appellate litigation regarding the regulatory authority of a variety of federal agencies, including the FCC, the Food and Drug Administration (FDA), the U.S. Department of Agriculture (USDA), and the U.S. Department of Health & Human Services (HHS).
