Joe's practice includes a broad range of regulatory compliance, environmental litigation, legislative, and transactional matters on behalf of major domestic and foreign manufacturers and trade associations.

Representative Experience

  • Represents consumer product manufacturers in Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) arbitrations and Environmental Protection Agency (EPA) enforcement proceedings regarding data compensation and alleged pesticide registration violations.
  • Advises electronics and battery recycling organizations regarding compliance with electronic waste and battery recycling laws and the drafting, interpretation, and enforcement of recycling services contracts.
  • Represents intervenor-defendants in litigation brought pursuant to FIFRA, the Endangered Species Act, and the Administrative Procedure Act against the U.S. Fish and Wildlife Service and the EPA regarding agency approval of pesticide registration applications. 
  • Counsels major manufacturers on Clean Air Act (CAA) stationary and mobile source regulatory matters, including emissions testing, emissions labeling, importation, and phased emissions compliance programs.
  • Negotiated settlement agreements with the EPA regarding alleged CAA violations.
  • Advises major corporations on regulatory requirements under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA) and other environmental laws regarding closure, sale, and remediation of contaminated sites.
  • Advised major manufacturers regarding legal strategy and development of natural resource damages assessments under CERCLA and the Oil Pollution Act (OPA).
  • Drafted legislation and regulations for several U.S. states on behalf of a Fortune 500 company to ensure national uniformity for safety standards governing client's product.
  • Provided extensive guidance to client regarding impact of proposed product safety legislation and regulation.
