Mr. Pickard’s practice encompasses the laws and regulations governing international trade and business transactions, with particular emphasis on import remedy, national security and export controls issues. Mr. Pickard represents and advises clients in matters related to trade remedy investigations (including antidumping, countervailing duty and safeguard cases), U.S. economic sanctions, export controls, antiboycott measures, the Foreign Corrupt Practices Act (FCPA) and the Foreign Agents Registration Act (FARA). In addition to advising both U.S. and non-U.S. clients on application and enforcement issues, he provides comprehensive guidance with regard to compliance with such laws, including: assessing and resolving sensitive matters, to include national security and intelligence-related concerns; developing global corporate compliance programs; establishing compliance with the National Industrial Security Program (NISP) and mitigating Foreign Ownership, Control or Influence (FOCI) issues; conducting internal investigations relating to potential violations; and appearing before the relevant agencies in connection with investigations, licensing and enforcement actions. Mr. Pickard represents clients in front of the U.S. International Trade Commission, the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), the U.S. Department of Justice, the U.S. Department of State’s Directorate of Defense Trade Controls (DDTC), the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) and International Trade Administration (ITA), and the U.S. Department of Defense's Defense Security Service (DSS).


REPRESENTATIVE EXPERIENCE

  • Represents U.S. and foreign companies in antidumping, countervailing duty, "sunset" and Section 201 investigations before the U.S. International Trade Commission and the U.S. Department of Commerce.
  • Advises U.S. and foreign entities regarding economic sanctions regulations administered by OFAC governing trade with Cuba, Iran, Sudan and "Specially Designated Nationals."
  • Litigates before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit.
  • Represents U.S. companies in regard to obligations under the International Traffic in Arms Regulations (ITAR).
  • Advises U.S. and foreign companies on the development and implementation of corporate compliance programs in the areas of the FCPA, export controls, economic sanctions and antiboycott laws.
  • Represents U.S. companies in obtaining licenses under the Export Administration Regulations (EAR).
  • Assists both buyers and sellers in regard to export controls and FCPA due diligence within the context of mergers and acquisitions.
  • Conducts internal investigations relating to potential export controls and FCPA violations.
  • Counsels clients in regard to U.S. election, lobbying and government ethics laws and regulations.
