Mr. Baker has 30 years of experience in representing and advising a broad range of clients on domestic and international communications, privacy, consumer marketing, e-commerce, and postal law.


REPRESENTATIVE EXPERIENCE

  • Represents device manufacturer in National Telecommunications and Information Administration (NTIA) multistakeholder proceeding regarding transparency in mobile applications.
  • Advises clients on privacy and data security issues arising under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Do Not Call Act, the Children’s Online Privacy Protection Act (COPPA), state data security breach notification laws, and international privacy and data transfer laws.
  • Successfully defended telecommunications provider’s advertising claims in National Advertising Division advertising review challenge.
  • Represents website publishers in Federal Communications Commission (FCC) and Federal Trade Commission (FTC) proceedings regarding consumer privacy and data security, location-based services, behavioral advertising, and related new media issues.
  • Represents First Class business mailers and newspapers in litigation, rulemaking, counseling, and legislative matters involving the rates and classifications of the United States Postal Service (USPS).  Participated in every major proceeding before the Postal Regulatory Commission (PRC) since 1987.
  • Counsels companies regarding applicability of the Private Express Statutes (PES). 
  • Drafted transactional and regulatory filings as principal outside counsel to leading company in the business of managing consumer privacy.
