| pdavis@wileyrein.comA former clerk on the Federal District Court, Mr. Davis represents clients on a broad range of government contracts and related litigation matters, including bid protests, contract disputes, claims preparation and litigation and government investigations and audits. Mr. Davis has participated in several due diligence reviews in mergers and acquisitions, focusing on government contracts and litigation issues, and regularly teaches a course on that subject. He serves as a Vice Chair of the American Bar Association Section of Public Contract Law’s Committee on Professional Responsibility and Contracting Ethics, from which perspective he counsels clients on and conducts reviews of ethics/compliance programs, and drafts ethics/compliance policies.
REPRESENTATIVE EXPERIENCE
- Represents clients in claims and disputes for matters totaling over one billion dollars before the Armed Services Board of Contract Appeals, the Civilian Board of Contract Appeals and the Postal Service Board of Contract Appeals, including the alternative dispute resolution procedures of such Boards.
- Litigates bid protests at the U.S. Government Accountability Office (GAO), the U.S. Court of Federal Claims and federal agencies, including hearings and oral arguments.
- Advises clients in preparation of requests for equitable adjustment and claims before federal agencies.
- Conducts and prepares internal assessments and reviews of clients' ethics and compliance programs and policies, and drafts and revises such programs and policies. Also advises clients on ethics and compliance matters as they arise in contract performance and in course of business.
- Represents clients in mergers and acquisitions, focusing on due diligence in the government contracts and litigation areas.
- Advises clients on contract administration issues, teaming agreements and subcontracting relationships, and general compliance with statutory and regulatory obligations of government contractors.
