Kirk Nahra Discusses Medical Providers’ HIPAA Liability after Connecticut Ruling
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in an article published November 5 by Bloomberg BNA’sHealth Law Resource Center about a recent ruling by the Connecticut Supreme Court that a plaintiff can sue a medical provider for negligence in state court based on alleged violations of Health Insurance Portability and Accountability Act (HIPAA) privacy rules.
Mr. Nahra said that the decision was “important” given that this is the highest court thus far to rule on the issue. He posited that the court was “looking for a solution to this problematic situation,” adding that in other circumstances it would not “be appealing to try to find a remedy.”
