Kirk Nahra Discusses 2015 Outlook for Top Health and Privacy Issues
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted extensively by Bloomberg BNA in two articles about the most important regulatory and legal issues facing health care organizations in 2015.
Mr. Nahra is a member of the advisory board for BNA’s Health Law Reporter, which ranked privacy and data security second on its list of this year’s top 10 health care issues. There are still “way too many security breaches in the health care area,” he told the publication in a January 8 article. He added that data security challenges will demand strategic thinking from corporate boards and leadership. “I expect increased and ongoing pressure related to cybersecurity risks and similar challenges related to how health care companies use data, with an increased recognition that these are issues that call for board-level engagement,” he said.
With respect to anti-fraud compliance, a key issue will be the Center for Medicare & Medicaid Services’ Open Payments Program, Mr. Nahra told BNA’s Health Care Fraud Report in a January 7 article. He said he “would absolutely expect this program to lead to new lawsuits—it’s going to be an appealing area for enterprising and creative whistleblowers (and their attorneys).” But he predicted that many of those lawsuits will not be successful.
