Kirk Nahra Discusses Top Privacy Cases to Watch in 2015

Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in a July 14 Law360 article about privacy cases to watch in the second half of 2015.

Attorneys anticipate that upcoming decisions by the Supreme Court of the United States on massive data breach cases will change the way privacy class action lawsuits are litigated, according the article. “[These cases] could fundamentally disrupt (or reinforce) the broadest security enforcement authority,” Mr. Nahra said.

Major data breaches in the past two years that have dominated headlines include those related to Target Corp., Sony Pictures Entertainment Inc., Home Depot Inc., and Anthem Inc. as well as the cyberattack on the U.S. Office of Personnel Management. Mr. Nahra said these data breach cases each seem to bring a new theory of damages. “We are all watching to see if anything sticks,” he added.
