Kirk Nahra Discusses HHS Office of Inspector General Report on Terminated Medicaid Providers
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in an article published August 5 in BNA Snapshot about a report released that day by the Department of Health and Human Services’ Office of Inspector General.
According to BNA Snapshot, the report detailed that 295 of 2,539 providers that were terminated from individual state Medicaid programs in 2011 were still participating as of January 1, 2012. Furthermore, two years later 172 providers were still participating in Medicaid. The report concluded that continued involvement of the providers could lead to increased fraud, abuse, and waste in the Medicaid program.
“We have a fragmented system, with each state running its own data and program rules,” Mr. Nahra said. “This is a result of a state-based system, essentially between running Medicare as a national program and Medicaid as a state program.”
