Kirk Nahra Discusses Health Data Breach Lawsuit Filed Against Intermedix Corp.
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice and co-chair of the Health Care Practice, was quoted in an article published August 6 in HealthcareInfoSecurity about a lawsuit filed last week against Intermedix Corp.
According to the article, the suit claims that Intermedix’s negligence led to a data breach involving a former employee who was ultimately convicted of tax fraud and that the company failed to promptly notify victims. The lead plaintiff in the case, who is also seeking class action status, claims that he is a victim of federal income tax fraud.
Using evidence of tax fraud stemming from identity theft tied to a data breach to support a class action lawsuit seeking damages is “tricky because the government is often the actual victim,” Mr. Nahra said.
“Also, in other cases I have seen, the tax fraud affects a very small percentage of people whose information was potentially available to be accessed,” he added.
