Kirk Nahra Comments on OIG Report on Medicare Billing Rights
Health Care Practice co-chair Kirk Nahra was interviewed by Bloomberg BNA for a story on an alert issued by the Department of Health and Human Services Office of Inspector General that stated physicians may be liable for any false claims submitted through an eligible health care provider to Medicare.
The article reported that under Medicare, a physician must file Centers for Medicare & Medicaid Services form 855-R to allow another entity to submit Medicare claims and receive payments for services.
Mr. Nahra told Bloomberg BNA that the alert was focused on suspicious reassignment arrangements and that the federal government can use this rule to show that a physician caused the false claim to be submitted through the reassignment. Mr. Nahra added that the alert is a "reminder to physicians to be very careful in this area and a reminder that it's not a good excuse to say 'I didn't know something fraudulent was going on.'"
