Kirk Nahra Discusses BlueCross BlueShield Settlement with HHS
Privacy Practice chair Kirk Nahra was interviewed by Bloomberg BNA for a story on increased enforcement efforts by the federal government in the wake of the recent $1.5 million settlement between BlueCross BlueShield of Tennessee and the Department of Health and Human Services (HHS).
The article reported that the agreement is the first monetary settlement directed at a health plan, resulting in the need for covered entities to address physical security issues for protected health information.
Mr. Nahra said that the settlement "should really start to get the attention of the health care industry" and that the penalty resulted from "a somewhat common kind of breach, where the breach was reported properly." He added that the settlement indicates that "HHS is ramping up its enforcement efforts on health care privacy and security violations."
