Christopher Weld Discusses Trump’s Buy American Directive

Christopher B. Weld, a partner in Wiley Rein’s International Trade Practice, was quoted by Inside U.S. Trade  in an April 19 article regarding President Trump’s “Buy American and Hire American” Executive Order, which has been commended by the domestic steel industry for targeting strict enforcement of “Buy American” requirements and reaffirming the “melted and poured” standard.

Mr. Weld noted that the “melted and poured” standard—which was established in the U.S. Department of Transportation’s 1982 Buy America provisions— is important to domestic manufacturers because it ensures that all steel manufacturing processes occur in the United States for a product to be considered American-made.  

He also said the directive reflects a commitment to ensuring that the impact of “Buy American” policies are felt throughout the entire steelmaking supply chain.  “The ‘melted and poured’ standard has been under attack by foreign interests for years,” Mr. Weld told Inside U.S. Trade.

Mr. Weld said the “real impact” of the order will depend on the recommendations contained in the report to the President and whether or not they are fully implemented.

However, he said the order would likely have the “immediate impact” of increased compliance with Buy American laws as well as fewer waivers, resulting in an increase in U.S.-made products on government-related projects.
