Jan Baran Weighs In On Super PAC Donations by 'Ghost Corporations'
Jan Witold Baran, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted in a March 18 article published in The Washington Post about “ghost corporations” making six- or seven-figure contributions to super political action committees.
According to the article, the practice is considered by some to violate a ban on straw donors. However, the deep partisan divide at the Federal Election Commission (FEC) has created a deadlock whether to even investigate the cases.
Mr. Baran said that the FEC should weigh in on the issue. He also noted that the FEC has not issued rules on corporate donations since the 2010 FEC v. Citizens United decision by the Supreme Court of the United States.
“The agency is just not providing any legal guidance on what the rules are in the aftermath of all these momentous court decisions,” Mr. Baran said. “That’s the job of the FEC, and it hasn’t done its job.”
