Kirk Nahra Featured in Radio Segment on Ashley Madison Data Breach Litigation
Kirk J. Nahra, chair of Wiley Rein’s Privacy Practice, was featured in an August 28 Bloomberg Radio segment about data breach lawsuits against AshleyMadison.com, a website that aims to facilitate extramarital affairs. The suits were filed after hackers reportedly released the personal information of more than 37 million possible users of the site.
“This is a trend we’ve been seeing in all of these large security breach cases,” Mr. Nahra said of the litigation, which alleges that AshleyMadison.com and its parent company failed to protect users’ data.
“It’s become almost a reflexive step from the plaintiffs class action bar to file lawsuits when there is an announcement of a large security breach, even though the history has been that these cases are very difficult to bring, and most of them have been unsuccessful for a variety of reasons,” Mr. Nahra added. “This case obviously is going to present some additional complications as well as perhaps some additional opportunities for the plaintiffs.”
