Do I Need New HIPAA Business Associate Agreements?
Kirk Nahra's article examining this question appeared in the June 27 issue of Bloomberg BNA's Health Law Reporter.
The question of whether to secure new business associate agreements is timely because of the impending September 23 compliance date of the Health Insurance Portability and Accountability Act (HIPAA) omnibus regulations. The article discusses a number of factors a covered entity or business associate should examine in reaching a decision on whether to seek new business associate agreements, a decision that is a complicated one. Nahra stresses that “ensuring an appropriate business associate agreement program is not only a compliance requirement but also an important best practice throughout the health care industry.”
