WRF Files Amicus Brief for Wireless Industry in Supreme Court Tower Siting Case

On December 17, 2004, WRF filed an amicus brief with the Supreme Court on behalf of the Cellular Telephone & Internet Association in City of Rancho Palos Verdes v. Abrams, No. 03-1601. The CTIA brief details the history of local zoning authorities' obstruction of the deployment of necessary wireless infrastructure, and urges the Supreme Court to uphold the Ninth Circuit's conclusion that damages and attorney's fees may be awarded to wireless carriers under 42 U.S.C. 1983 for violation of their federal rights under Section 332(c)(7) of the Communications Act. The case marks the first time the Supreme Court has addressed the hotly litigated issue of cell tower siting. Argument is set for January 19, 2005 and a ruling is expected by June 2005.
