Wiley Rein’s White Collar Defense & Government Investigations Group is an elite team regularly called upon to navigate Fortune 500 companies, small and medium companies, business executives, and public officials when they are confronted with criminal and civil government enforcement actions and investigations. The Group is composed of former Assistant United States Attorneys, former congressional investigative counsel, former U.S. Department of Justice (DOJ) and U.S. Securities and Exchange Commission (SEC) attorneys, and a deep pool of home-grown talent specializing in government investigations and litigation.

We have expertise across all aspects of criminal and civil enforcement actions, with specialization in the areas of:

  • Civil Fraud, False Claims, Qui Tam and Whistleblower Actions – We investigate and litigate government, private qui tam,and whistleblower actions under the False Claims Act (FCA) and, where appropriate, negotiate favorable settlements to resolve allegations of fraud.
  • Communications Enforcement and Compliance – We combine substantive knowledge of the rules and policies of the Federal Communications Commission (FCC) and Federal Trade Commission (FTC) with our extensive experience in litigation and investigations to defend against FCC and FTC enforcement actions.
  • Congressional Investigations and Oversight – We represent clients in all stages of congressional proceedings and investigations, and responses to inquiries, requests for documents, requests for interviews, and public testimony.
  • Criminal Investigations and Prosecutions – We defend corporations, executives, and government officials in grand jury investigations, trials, parallel civil/criminal investigations, and other federal and state proceedings.
  • Foreign Corrupt Practices Act (FCPA) – We investigate and defend complex enforcement actions arising under the FCPA, and assist clients in creating corporate compliance programs designed to avoid FCPA actions.
  • Internal Investigations and Compliance Programs – We conduct internal investigations and compliance reviews to identify potential or existing improprieties and counsel clients regarding the correct course of action based on the results, including difficult questions about disclosure.
  • Securities Enforcement and Litigation – We defend our clients’ interests before the SEC, the U.S. Commodity Futures Trading Commission, the Financial Industry Regulatory Authority, and the Public Company Accounting Oversight Board.

  • Represented a government contractor during civil and criminal investigations into its alleged involvement in what has been described as one of the largest bribery and kickback schemes in the history of federal contracting.
  • Responded to multiple, concurrent investigations by three different committees in the House and Senate, as well as a barrage of media inquiries regarding a high-profile, politically-charged government IT project.
  • Defended a government official indicted for making false statements and obstructing justice in connection with the agency and congressional investigations into lobbyist Jack Abramoff's dealings.
  • Conducted numerous internal investigations for major government contractors related to an array of procurement integrity and other concerns.
  • Secured dismissal of a qui tam suit by three former employees of a contractor who alleged FCA violations and retaliation, after convincing DOJ not to intervene.
  • Defended Members of Congress related to House and Senate Ethics investigations and related criminal and civil allegations.
  • Defended several businesses and executives in DOJ Public Integrity investigations relating to conduit contributions.
  • Defended a video relay services provider in concurrent investigations of fraud by the DOJ, SEC, and the FCC Enforcement Bureau, convincing the DOJ and SEC not to take any criminal or civil action and resulting in an administrative resolution with the FCC.
  • Defended foreign generic pharmaceutical manufacturer in government pricing investigation.
  • Defended several executives of medical device manufactures in DOJ and U.S. Food and Drug Administration investigations relating to off label marketing.
  • Defended major hospital in FCA investigation involving Stark Act and anti-kickback allegations.
  • Defended several corporate executives in international cartel investigations.
  • Conducted multiple FCPA internal investigations for government contractor with world-wide operations.
